Understanding Personal Injury Law: Your Rights and Legal Options

These types of cases can be difficult to pursue as crimes are typically not covered under insurance policies and many individuals do not have enough assets to justify a lawsuit.

 

Strict liability is when an individual or company is held liable in the absence of intent or negligence. The types of actions of behaviors that constitute strict liability are often determined by statute or case law. Examples of strict liability include injuries from dangerous animals (including dogs) and product liability. A dog owner whose dog bites and injures another, is liable for those injuries regardless of whether the dog owner directed the dog to attack the person, or whether the dog owner was negligent in their training or handling of the dog. Companies who manufacture products are strictly liable for harm done by defective products. Liability in these instances can also extend to a seller of that item if they knew, or should have known, that the product was defective.

 

The last type of personal injury is negligence. 

 

Common Types of Personal Injury Cases

Personal injury claims arise from a variety of situations, including:

  1. Car Accidents – One of the most common personal injury claims, where negligent driving leads to injuries.
  2. Slip and Fall Accidents – Property owners can be held liable for unsafe conditions that cause injuries.
  3. Medical Malpractice – When healthcare professionals provide substandard care, resulting in patient harm.
  4. Product Liability – Manufacturers can be responsible for defective products that cause injuries.
  5. Workplace Accidents – Employees injured on the job may have claims beyond workers’ compensation in some cases.
  6. Wrongful Death – A claim filed on behalf of someone who has died due to another party’s negligence.

Elements of a Personal Injury Claim

To successfully pursue a personal injury case, the injured party (plaintiff) must prove the following elements:

  • Duty of Care – The defendant had a legal obligation to act reasonably and prevent harm.
  • Breach of Duty – The defendant failed to meet their duty of care through negligence or misconduct.
  • Causation – The breach of duty directly caused the injury.’
  • Damages – The plaintiff suffered actual losses, such as medical expenses, lost wages, or pain and suffering.

Compensation in Personal Injury Cases

Victims of personal injury may be entitled to different types of compensation, including:

  • Medical Expenses – Costs for hospital stays, surgeries, medications, and rehabilitation.
  • Lost Wages – Income lost due to the inability to work.
  • Pain and Suffering – Compensation for physical and emotional distress.
  • Property Damage – Coverage for personal property damaged in the incident.
  • Punitive Damages – In cases of extreme negligence, additional damages may be awarded to punish the wrongdoer.
